Illinois Attorney Rules Set for a Makeover
    2008-03-19 08:07:07
In law school, future attorneys are trained in the "ABA Model Rules of Professional Conduct" and most are tested on these rules as part of the Bar exam. However, once practicing attorneys, they must abide by the individual ethics rules of the state - or states - in which they are licensed. This creates a particular challenge for the nearly one-third of Illinois attorneys licensed in multiple jurisdictions.

    Sherk's Attorney Formally Protests Hearing Date - 09 Nov 2007 09:01:45pm
    2007-11-09 15:01:45
By Loretta Hunt Howard Jacobs, the attorney representing UFC lightweight champion Sean Sherk in his appeal of a California State Athletic Commission suspension for suspected steroid use, has formally protested the latest scheduled hearing date of Tuesday, Dec. 4 in Los Angeles. Sherk’s case has already been postponed twice. Jacobs said all parties involved, including commissioners and the state’s legal counsel – Deputy Attorney General Karen Chappelle – had agreed to reconvene for a Nov. 13 hearing, provided they could secure a room in which to conduct it. “I seemingly can’t force them to give me an explanation as to why the deputy attorney general suddenly became unavailable [for Nov. 13] when she said she was available,” Jacobs said. “I can’t get them to explain to me why there’s no one in the entire State Attorney General’s office who can handle the case or why – if there was another matter that came up for Karen Chappelle – she can’t postpone that matter, because she already agreed to this one. I’ve asked for answers to all those questions, and I haven’t been told anything.” (Continue Reading)

    Attorney General Alberto Gonzales Resigns
    2007-08-27 23:48:06
Today Alberto Gonzales announced his Resignation from his position as Attorney General of the United States. While many on the Right will move to defend Gonzales, I am certainly not one of those people. Alberto Gonzales was an abject failure, who demonstrated utter incompetence. Had Alberto Gonzales not held the position, virtually none of the fake scandals would have arisen. There are some major benefits to Gonzales’ resignation, however, other than a competent person taking his place. The first benefit is that the Democrats are not going to be able to deflect attention from their own shortfalls. With Karl Rove and Alberto Gonzales gone, this may require the Democrat Party, led by Nancy Pelosi and Harry Reid, to actually accomplish something. Since Nancy Pelosi and Harry Reid took office, not only has this Congress become one of the most corrupt in history, but neither The Speaker or the Majority Leader can get their Party in order. Now the American people can tell Reid and Pelo

Drafting My Will, Financial Power of Attorney, and More
    2007-07-03 08:00:42
The first time I recall my parents mentioning their Will was in advance of a trip to Alaska to celebrate their 25th wedding anniversary. My Dad had written up a list of instructions for what to do if their plane were to go down. I remember trying to play it off, and not think about the possibility. Luckily, the trip went like clockwork, though they’ve reminded me of the list ever since. I am now in uncharted territory, having very little debt, and a lot of savings. As a result, and in the event I am knocked off by narco-terrorists or a gonzo sting ray, I decided it would be prudent to draft a Will before leaving the country. In addition, I wanted to give my Mom Financial Power of Attorney so she could act on my behalf (such as being able to deposit money to my accounts, cash checks, help me with my taxes, etc.). Rounding out the legal trifecta would be an Advance Medical Directive in case I end up in a vegetative state someday. Initially, I expected to have to hire a lawyer

New York Must Reform its Laws on Power of Attorney
    2007-06-30 14:08:00
As many as 5 million older adults in the United States have been victims of elder abuse and neglect. In New York alone, out of the 3.1 million older adults over 60, as many as 130,000 may be victims of mistreatment. Elder abuse takes many forms: physical battering, neglect by caregivers to provide for basic needs such as food or medicine, emotional or psychological mistreatment. One of the most insidious forms of abuse perpetrated against older adults is financial exploitation. As in other forms of abuse, financial exploitation cuts across all economic and ethnic boundaries; it affects not only the affluent but also those of limited means. It is also the fastest growing form of elder abuse. The National Elder Abuse Incidence Study in 1998 found that almost one third of elder abuse cases involve exploitation. Frail elders who are isolated and dependent on others for care or who may be experiencing confusion are especially vulnerable. In some cases unscrupulous home contractors or telema

GOP Bloggers… oh, and the Attorney General
    2007-06-14 03:09:20
Why is it that so many right wing blogs go for names that ring of ‘bossy’, ‘dogmatic’, ‘go tell it on the mountain’, and just plain ‘arrogant’? Take, for example, The Cold Hearted Truth, Great Minds Think Right, The Right Stuff, Obviously Right (Because we’re Right, obviously), and The Bull Speaks. Doesn’t this violate the dictum that the comedian not laugh at his own jokes? I mean, if you’ve got to tell people right in the headline that you are right about being right and trump up the truthiness of your ‘truths’ by telling everyone that those truths are true, then maybe you just aren’t as right about it as you think? Could be? Maybe? You don’t see those kinds of gung-ho, chest beating blog titles at the Independent Bloggers Alliance or at Liberal Oasis. You find some tongue-in-cheek there. You find some ’shock value’. But little of this ‘I’m a great big silverback hear me

Assistant Kenton County Attorney Ken Easterling to be Honored for Fighting Elder Abuse
    2007-05-18 13:45:00
Post staff reportThe Northern Kentucky Elder Maltreatment Alliance planned to honor Assistant Kenton County Attorney Ken Easterling this morning for aggressively prosecuting cases of elder abuse and for otherwise advocating for older persons.Easterling has been in the news lately because of his investigation of complaints against Villaspring of Erlanger nursing home, but the award was in the works before that investigation became public last week, said Pat Schneider, chair of education and public relations for the Elder Maltreatment Alliance. She said the award recognizes Easterling's work on several cases now in the court system. She would not identify any of the cases. But one notable case handled by the county attorney's office last year involved a Fort Wright couple who befriended an 85-year-old woman and were charged with spending her money to buy a house, an SUV, expensive furniture and vacations for themselves while the woman lived in a windowless room in the basement.Schneider

    2007-05-16 13:30:00
Maine Attorney General Steve Rowe praised the passage of L.D. 1428, “An Act to Facilitate Reporting by Maine Financial Institutions of Elder Financial Exploitation”. This legislation provides immunity to banks and other financial institutions for good faith disclosures of suspected financial exploitation of dependent adults.“This law provides Maine people an additional resource to help shield seniors from abuse, neglect and exploitation.” Rowe said. “The fundamental role of government is to protect the most vulnerable among us. By enacting this law we have done just that.”The bill, which was submitted by the Attorney General and sponsored by Rep. How the U.S. Attorney Purges and Pakistani Judge Firings Are Similar

A controversial leader is coming under fire for the dismissal of one of his legal representatives. Critics say he did it for political reasons. No, this post isn’t about the U.S. attorney purge scandal; it’s about the suspension of Iftikhar Mohammad Chaudhry, the Chief Justice of Pakistan. From Wikipedia:Justice Chaudhry was summoned by the President General Pervez Musharraf at his Army residence in Rawalpindi on Friday, 9 March 2007 and asked to explain his position on a list of charges brought against him from several quarters.
