    Maybe Not Disability Discrimination

    We ran a post last week about disability discrimination involving a school inclusion choir. It is interesting how people watching the same event can see many different things.We have heard from some folks this week who don't think that there was any discrimination at this event. They tell us that there were two choirs, one for grades 6 to 9 and one for grades 10-12, and that the vest was the uniform for one age group- not the uniform for nondisbaled peers. They also say that one whole choir sat down for the second song, not just the kids with disabilities. Moreover, they assert that many of the kids in both choirs had disabilities that may not be visible, such as LD or hearing impairment, so that it would be impossible to visually identify them. I'm not sure I understand why one choir had to sit down during a performance, but this explanation would negate any discrimination. If there was no discrimination, I apologize for calling it such.     State Insurance Tax Discrimination Case Won't Be Reheard

    We received word yesterday that the South Dakota Supreme Court has declined to rehear the Metropolitan Life Ins. Co. v. Kinsman insurance tax discrimination case; the Tax Foundation had filed an amicus brief in support of the petition for rehearing. South Dakota is one of 8 remaining states that seek to protect their domestic insurance companies by imposing heavier taxes on out-of-state companies that do business in the state. The result is effective discrimination against out-of-state companies, which violates the Equal Protection Clause, as the trial judge concluded. The issue raised by the Kinsman case implicates states with similar discriminatory insurance tax systems. It is most relevant for states with similar statutes: Colorado, Hawaii, and Nevada, where domestic companies also automatically qualify for a lower rate but out-of-state companies have to clear additional burdens and often fail to do so. Reading statements reported in the Champaign-Urbana News-Gazette, where the statements are no doubt the tip of an iceberg, it is clear that the Witch School opposition itself has no significant opposition to check its active discriminatory bias against witches and by extension, against those it deems religiously unworthy by a particular Christian definition to exist or flourish within the community. Each time the facility chose not to hire me for those full time positions to which I applied. Despite that I reiterated this fact to the unemployment adjudicator, he chose to believe the lie over the truth.Harrassment and discrimination. Now, not only am I a victim of pervasive employment discrimination but I am a victim of unemployment discrimination as well. Of course, this is not the first time a nursing facility has protested my unemployment benefit following firing me for religious-related reasons.
