| | Mass. elders without families have no protection against being declared incompetent! | | 2008-01-15 17:34:00 | | Yesterday the Boston Globe reported on the risks of being a Massachusetts elder without family and friends-- you might find yourself placed into state custody against your will!I didn't want to write this post until I had some good news to go along with the bad, but haven't been able to find much. Surely elders placed into state guardianship are at least entitled to legal representation, right? Well, not that I could figure out.Every year an unknown number of elders are declared incompetent and placed in state guardianship at the request of nursing homes, hospitals and others. They then become virtual prisoners of the nursing home, with no legal representation, no access to money or even the ability to find out where their money and belongings are, and no one to watch out for them. Some of these elders, of course, do meet the legal definition of incompetent, defined in the Law.com Dictionary as " referring to a person who is not able to manage his/her affairs due to mental deficiency (low I.Q., deterioration, illness or psychosis) or sometimes physical disability. Being incompetent can be the basis for appointment of a guardian or conservator (after a hearing in which the party who may be found to be incompetent has been interviewed by a court investigator and is present and/or represented by an attorney) to handle his/her person and/or affairs (often called "estate"). They need help and they should get help, but they do not deserve to be treated like children. Actually, I take that back, even children don't deserve to be treated the way they are.A few of the unjustly confined do manage to get out. "In December 2006, it took just 2 minutes and 10 seconds for Mass. General to convince Judge Merrill that 74-year-old Rose Doyle should be put in the care of a guardian. Doyle was confined to a nursing home for three months. She complained to Greater Boston Legal Services. In May 2007, after an outside psychiatrist concluded that Doyle was competent, Merrill rever | | By: Michaelann Land | | |
| | Depression In Families | | 2008-01-13 00:32:00 | | There's no single known cause for depression. The illness often runs in families. Experts believe a genetic vulnerability combined with environmental factors, such as stress or physical illness, may trigger an imbalance in brain chemicals called neurotransmitters, resulting in depression. Imbalances in three neurotransmitters — serotonin, norepinephrine and dopamine — seem to be linked to depression.Scientists don't fully understand how imbalances in neurotransmitters cause signs and symptoms of depression. It's not certain whether changes in neurotransmitters are a cause or a result of depression. | | By: HealthyBodySoul | | |

| | | Rush Limbaugh Sells Harry Reid’s Letter on eBay to Support Military Families | | 2007-10-13 01:31:44 | | Rush Limbaugh today demonstrated he may be the most politically savvy person in America. After weeks of Media Matters, Moveon.org, and the Democrats in Congress, taking Rush’s statements out of context and claiming he attacked the troops, Rush Limbaugh clearly has won this battle.Harry Reid sent a formal letter to Clear Channel Radio, signed by 41 Congressmen, asking that Rush Limbaugh apologize to the Troops. I guess according to Harry Reid, Rush should apologize for having his statements distorted? Anyway, what Rush did next was truly brilliant, and patriotic. The entire proceeds of this auction, the entire high bid, will be donated to The Marine Corps - Law Enforcement Foundation, a registered charity which provides financial assistance to the children of fallen Marines and federal law enforcement officers. Rush Limbaugh serves on the Board of this organization and has been active on its behalf. All costs of this auction will be paid by the seller... every dollar of your winning bid will go to this charity, which has to date distributed over $29 million.Best of all, Rush asked all of the 41 disgraced Congressmen to match the bid to demonstrate how much they really support the troops. Justice Department Adult Guardian Dianne Pendergast said 145 cases of elder abuse were under investigation in Queensland. One woman lost her $750,000 home after granting a relative power of attorney.Another returned from hospital to find her house had been sold.Ms Pendergast said a growing number of "predators" wanted their parent's assets. | | Constitutional Protections Don't Apply To Department Of Children And Families Investigations. | | 2007-06-18 14:15:00 | | By Jennifer Abel Courtesy of Thinking Mother BlogWhen accused of a crime you’re guaranteed certain constitutional rights, like the right to face and confront your accusers, have a jury trial, know the charges are against you and see what evidence the state has to support them. But none of these apply if you’re investigated by the Connecticut Department of Children and Families.“The [DCF] is not a law enforcement agency and does not charge citizens with crimes,” department spokesman Gary Kleeblatt said in an e-mail. “Therefore, the agency has no involvement in the enforcement of constitutional rights that relate solely to criminal activity (jury trial, confront accuser).”“It’s a gimmick,” charges Michael Agranoff, an Ellington-based attorney who specializes in defending parents in DCF cases. “Making [these cases] civil instead of criminal is a gimmick to get around the fourth, fifth and sixth amendments to the Constitution.” Abridged >>Send your comments to jabel@h | | By: Elder Abuse | | |

Part of that recovery generally includes meetings with other recovering people with time spent away from home once again. The more the family members learn about recovery, the better they will be able to support the addicts recovery and their own recovery (generally from codependency).
