Anyone who has read this blog from the start may remember that the very first entry was about last year's Arqiva Commercial Radio Awards, which I was invited to attend as a guest at the Radio Magazine's table.
On 7 July, the event was held once again at the Royal Lancaster Hotel in London and compered, as usual, by Virgin Radio's Christian O'Connell.
At these awards, they always have two guest music acts: a newcomer to open and a big name to close the proceedings. This year's closer was James Morrison, who had performed there as the unknown act just a few years earlier. His interview with Christian was positive, enthusiastic and funny and he gave a relaxed performance that was very well-received.

These vibrations place pressure on the ear drum which is inside the middle ear. There are some small bones inside this middle portion of the ear, named the hammer, anvil, and stirrup. Howard Jacobs, the attorney representing UFC lightweight champion Sean Sherk in his appeal of a California State Athletic Commission suspension for suspected steroid use, has formally protested the latest scheduled hearing date of Tuesday, Dec. 4 in Los Angeles. Sherk’s case has already been postponed twice.
Jacobs said all parties involved, including commissioners and the state’s legal counsel – Deputy Attorney General Karen Chappelle – had agreed to reconvene for a Nov. 13 hearing, provided they could secure a room in which to conduct it.
“I seemingly can’t force them to give me an explanation as to why the deputy attorney general suddenly became unavailable [for Nov. 13] when she said she was available,†Jacobs said. “I can’t get them to explain to me why there’s no one in the entire State Attorney General’s office who can handle the case or why – if there was another matter that came up for Karen Chappelle – she can’t postpone that matter, because she already agreed to this one. I’ve asked for answers to all those questions, and I haven’t been told anything.â€

Those of you familiar with special education law understand that I absolutely cannot comment on the facts of the cases.I do want to talk about the process of decision writing, however. This is one of the most important things that I work with hearing officers on while training them. It is a lot more difficult than it looks. There is generally a voluminous record: multi-volume transcripts and a ton of exhibits. From this jungle of paper we must cull findings of fact. Not everything in evidence, just facts of decisional significance. Then we must apply the facts to the law. The law sounds pretty simple, but in fact the IDEA is a huge statute, with amendments that appear to have been cut-and-pasted in almost random fashion, possibly by monkeys. For example, Section 615 is labeled "Procedural Safeguards," yet there are other procedural safeguards set forth in many other places in the Act, and at least a few (e.g., state complaints, the five-business day disclosure rule) that may be found only in the federal regs. Speaking of the federal regs, they must also be considered, including the 215 odd pages of fine print, tri-column analysis of comments by OSEP. Then of course, state regulations must be studied. It is a difficult and exhausting process.So if I'm a little grumpy the next few weeks- excuse me.I should note, however, that I love writing decisions. If the hearing officer does a good job, the decision should result in fair and just application of the law for the parents, the school district and the student. Hearing officer decisions are subject to appeal to court, as they should be, but the hearing officer generally has the first opportunity to fairly apply the law.
