| New Analysis of CaliforniaÂs Individual Income Tax Rates | | 2008-07-14 23:00:00 | | California has the dubious distinction of being the only state with a double-digit individual income tax rate. A new Tax Foundation Fiscal Fact examines the state's changing tax rates over the years in light of the current debate in the legislature on whether to increase the top rate again. From Fiscal Fact No. 134, "California Legislators Push for More Double-Digit Income Tax Rates," by William Ahern:The next major change occurred in 2004 when a ballot initiative added a new top bracket, 10.3 percent of income above $1,000,000. Perhaps because it was not enacted by the legislature in a normal tax-writing procedure, or perhaps because the revenue is transferred to a mental health services fund instead of the general fund, the Franchise Tax Board doesn't incorporate the new bracket into the existing rate structure on any of its forms. Instead, they still refer to 9.3% as the top rate, and the extra 1 percent over $1 million is extracted on a separate line of the tax form. But | | By: Tax Policy Blog | | |
| | California Releases Income Tax Rules for Same-Sex Spouses | | 2008-07-14 23:00:00 | | State Tax Review (subscription required) reports that the California Franchise Tax Board has issued rules for income tax filing by same-sex married couples. As in other states that have legalized gay marriage or civil unions, same-sex married couples in California will face added tax complexity. This is because they will be required to file as single for federal income tax purposes, but jointly (or married-filing-separately) for state income tax purposes. The California process will include determining a dummy joint federal Adjusted Gross Income, representing what the IRS would have deemed a couple's AGI to be, had they been able to file jointly at the federal level. While same-sex spouses will have to jump through some extra hoops to file, most will save some money on taxes through the process. California has no marriage tax penalty except in its highest income tax bracket, so couples earning less than $1,000,000 per year, whether gay or straight, generally see | | By: Tax Policy Blog | | |
| | Massachusetts Income Tax Repeal to Appear on November Ballot | | 2008-07-09 23:00:00 | | The Massachusetts Secretary of State announced today that an initiative to repeal the state income tax has qualified for the November ballot, as "Question 1." A previous income tax repeal initiative appeared on the 2002 ballot, and received 45% of the vote (885,000 votes) even though every major state newspaper and many elected officials opposed the effort. The effort has been launched by the Committee for Small Government, which gathered 123,000 signatures to put the initiative on the ballot. One of its organizers, Carla Howell, spoke to me a few minutes ago and believes that the 2008 effort will be much stronger than the 2002 effort, with vocal endorsements and activist support. She argued that repealing the income tax will improve economic growth in Massachusetts while cutting wasteful spending. The state income tax currently tops out at 5.3 percent, and brings in $12 billion in revenue (out of a $28 billion state budget, not including "off-budget" expenditures and | | By: Tax Policy Blog | | |

| | Study Looks at New Mexico Income Tax Reductions | | 2008-06-16 23:00:00 | | From 2003 to 2008, New Mexico lowered its state personal income tax in steps from 8.2% (2002) to 4.9% (2008). Over the same period, revenue from personal income tax collections did not decline but in fact grew from $923 million in 2003 to $1.186 billion this year. A new report from the Rio Grande Foundation urges the state to continue on this path, and consider eliminating the personal income tax like nearby states Nevada and Texas:As this study will show, eliminating New Mexico’s income tax is possible within just four years. Spending restraint is a necessity, but modest, not radical measures can do the job. In fact, based on Rio Grande Foundation analysis of recent revenue growth and personal income tax revenue numbers, New Mexico’s personal income tax could be eliminated simply by restraining annual General fund increases to just 4.5 percent.Read the full study here.Previous Tax Foundation pieces on New Mexico:New Mexico Fact SheetNew Mexico Proposes Video Game Tax to Pu | | By: Tax Policy Blog | | |
| | Study Says Labor Would Benefit Most From Corporate Income Tax Rate Cut | | 2008-06-02 23:00:00 | | The U.S. federal corporate income tax is currently 35 percent, second-highest in the world. If it were cut, who would benefit? Lots of people, says Harvard economics professor N. Gregory Mankiw:The ultimate payers of the corporate tax are those individuals who have some stake in the company on which the tax is levied. If you own corporate equities, if you work for a corporation or if you buy goods and services from a corporation, you pay part of the corporate income tax. The corporate tax leads to lower returns on capital, lower wages or higher prices — and, most likely, a combination of all three.A cut in the corporate tax as Mr. McCain proposes would initially give a boost to after-tax profits and stock prices, but the results would not end there. A stronger stock market would lead to more capital investment. More investment would lead to greater productivity. Greater productivity would lead to higher wages for workers and lower prices for customers.Mankiw's op-ed looks at seve | | By: Tax Policy Blog | | |

| | Oklahoma Adopts Income Tax Deduction for Organ Donation | | 2008-04-15 23:00:00 | | Oklahoma Governor Brad Henry has signed into law a 130-page omnibus bill that, among many other things, creates a $10,000 one-time income tax deduction for unreimbursed costs associated with donating all or part of a liver, pancreas, kidney, intestine, lung, or bone marrow (Section 37, pages 89-90). The bill directs the Oklahoma Tax Commission to write rules outlining what would be a deductible cost.Currently federal law prohibits paying people for donating organs, and some have proposed changing this system as the number of people on organ waitlists grow each year. Whatever the merits of those proposals or what Oklahoma has done, it may be a trend: this website indicates that Oklahoma is the 13th state to adopt some form of tax deduction for costs associated with an individual donating an organ. (The others are Arkansas, Georgia, Idaho, Iowa, Minnesota, Mississippi, New Mexico, New York, North Dakota, Ohio, Utah, and Wisconsin.) | | By: Tax Policy Blog | | |
| | Income Tax | | 2008-04-14 23:05:00 | | Today is the day US citizens must have their federal (and sometimes state) income tax returns in the mail (or filed electronically). Oh yes, mail it late and you'll be liable for penalties and interest. The alternative is to file for an extension, but you have to have that in the mail on time, too! In some cities, Post Offices stay open late on deadline day, in some places until midnight, to accommodate late filers. Not so in small towns! I used to work for a radio station that would set up a party at the Post Office from, say, ten til midnight, with coffee, donuts, and t-shirts for the last stragglers to get their forms in. We heard some pretty funny stories about why it took so long to get the forms finished! Too bad I don't remember any of them. My actual income tax bill wasn't so bad, because I didn't make much money (despite the rumors that bloggers make money), but the self-employment tax, the local occupational tax, and the 2008 quarterly withholding took a bite out | | By: Miss Cellania | | |

It's about how, to the government, the Income Tax is THEIR "root of all evil," and its creation with the 16th Amendment. It's kinda become like their version of a century old "crack-cocaine" fix. However, in all fairness, I seriously doubt that in 1913 when the amendment was first established the legislators could have perceived the immensity of today's government. I do believe they knew it would grow exponentially, but not ballooned, exploded if you will, to such an unnecessary extent. The article was written by Gary M. Galles (a Pepperdine Univ. Economics Professor) and is found in the Opinion section of Thursday's, April 10th edition of the Orange County Register. | | | BEA: Corporate Income Tax Collections in 2007 Grew at Slowest Pace in Five Years | | 2008-03-27 00:00:00 | | This morning, the Bureau of Economic Analysis (BEA) reported finalized GDP numbers for the fourth quarter of GDP, as well as figures for corporate profits and corporate income taxes paid for calendar year 2007. They show corporate income taxes growing at only a 2.1 percent pace in 2007, which is down by a lot compared to growth in 2006, which was 15.7 percent and 2005 when growth was 28.4 percent. The Congressional Budget Office is actually forecasting a decline (not just slower growth) in corporate income tax collections for this fiscal year.As a general rule, corporate income tax collections are much more volatile from year-to-year than other taxes, especially sales taxes and taxes on wages and salaries. Therefore, one downside to raising taxes on corporations, although the tax is often politically easy and a necessary backstop for the income tax system that we have, is that the revenue source is much more susceptible to large swings from year-to-year. | | By: Tax Policy Blog
| | Government increases income tax exemption limit | | 2008-02-29 02:06:00 | | Finance Minister P Chidambaram spread cheer all around with Budget 2008-09, the last full-fledged Budget of the UPA government. A hike in the income-tax exemption limit was one of the key highlights of the Budget. The finance ministry raised the income-tax exemption limit from Rs 1,10,000 to Rs 1,50,000. Exemption limit for women was raised from Rs 1,45,000 to Rs 1,80,000 and exemption for senior citizens was raised from Rs 1,95,000 to Rs 2,25,000. Direct tax collections have been buoyant this fiscal year, registering a growth of over 40% to Rs 2,18,538 crore in the first 10 months. The slabs were introduced three years ago, but the Prime Minister’s Economic Advisory Council has suggested a change in the structure. For income upto Rs 1,50,000 tax liability will be nil, between Rs 1,50,000 and Rs 3,00,000 tax liability will be 10%, from 3 lakh to 5 lakh tax liability will be 20%, from 5 lakh upwards it will be 30%. | | By: Indian stock markets | | |

| | Budget may give relief to income tax payers | | 2008-02-20 00:55:00 | | Income tax payers are likely to get a major relief in the Budget 2008-09, as the government prepares itself to please the middle class in the election year. Finance Minister P Chidambaram can give a marginal but visible relief to personal income tax assessees this year, as tax collections have substantially improved over the past three years. With buoyant tax collections in 2007-08, there is significant pressure on Chidambaram to reduce the effective rates. The Minister himself has acknowledged that with better tax compliance, there could be a case for cut in rates. The minimum income threshold limit for income tax payer could be raised from Rs 110,000 to Rs 125,000 or Rs 130,000. Similarly, the income threshold for 30% tax rate could be raised from the current Rs 250,000 per annum. This had been kept constant since fiscal year 2005-06. Tax payers would get a relief of Rs 1,500 to Rs 2,000 even if the Finance Minister decides to raise the minimum income threshold limit of income tax b | | By: Indian stock markets | | |

| | AMT Fix Now Even More Important for Maryland Given Income Tax Hike | | 2007-11-19 00:00:00 | | The State of Maryland is already one of the hardest hit states by the alternative minimum tax due to its high-income profile and high taxes on income and property. But now that a tax hike bill has been approved by the legislature and will likely be signed by Gov. O'Malley, the AMT is set to hit Marylanders even harder.Raising the state income tax from 4.75 percent to three new rates of 5, 5.25, and 5.5 for higher income residents will increase the state income tax deduction that people can take on their federal tax return, thereby essentially making the rest of the country bear part of the burden of Maryland's tax hike. (That's one reason why the Tax Foundation opposes the state and local tax deduction to begin with.) However, AMT takes that deduction away from taxpayers, and raising that deduction further in Maryland will mean more taxpayers will have their AMT liability exceed their regular tax liability, thereby forcing them into AMT.It should be made clear that no Mary | | By: Tax Policy Blog | | |

If everyone had EZ Pass, tolls lines would move much quicker, so naturally I want more people to get EZ Pass tags.West Virginia lawmakers obviously share my zeal for less congestion and shorter lines. Unfortunately, we disagree on how to entice more people to sign up for the time-saving program. From the Charleston Gazette:Under the new law, residents with the EZ Pass will be able to deduct up to $1,200 a year in Turnpike tolls and pass costs on their income taxes.Even though I want more people using EZ Pass, I don't want the tax code used as an incentive. | | Maryland’s Income Tax Already Among Nation’s Highest | | 2007-07-18 07:00:00 | | According to a story on the cover of today's Washington Post, Maryland Governor Martin O'Malley and other lawmakers are pushing to increase the state income tax. From the story:Gov. Martin O'Malley (D) and leading lawmakers say they are giving serious consideration to overhauling the state's tax brackets, which are among the flattest in the nation. "I'm in favor of progressive taxation, where people who make a lot more pay more," O'Malley told reporters recently. The Post's story compares Maryland's individual income tax structure to those in Washington, DC, Virginia, Vermont, California and New Jersey, citing Tax Foundation data. None of those states have local income taxes, though, and Maryland's are the highest in the nation. | | How Is Our Income Tax Unfair? | | 2007-07-17 07:00:00 | | In the New York Times's Economic View column July 15, Professor Gregory Mankiw graded the U.S.'s income tax on fairness. He didn't assign a letter grade, but it sounded as if our federal tax code would have gotten a B from the Harvard prof.At first he seemed willing to give the code an A, citing Congressional Budget Office data that proves Americans pay much more in tax the more they earn. That makes our federal tax steeply progressive, which is what people generally refer to as fairness. But then Mankiw pulled back, citing fairness guru and scholar John Rawls as someone who would have wanted even steeper progressivity. What I regret about the column is the missed opportunity to explain the other type of fairness, which our code deserves a D on, or maybe an F.This second type of fairness answers the question: If two people earn the same amount, do they pay the same amount? Alas, the answer is emphatically no. As Patrick Fleenor showed in a recent paper on the AMT, a fam | | By: Tax Policy Blog
| | What is a Federal Income Tax Refund? | | 2007-07-15 04:34:00 | | You are getting an income tax refund! Those are the words that every taxpayer would love to hear. Always remember that it is still better to get an IRS tax refund than to owe money to the government.Once you determine you are receiving a tax refund, there are several options for actually putting that money in the taxpayers hands. Standard paper filing, electronic filing with direct deposit, rapid refunds, and refund anticipation loans are the options we have the choice of exercising, and for many refund anticipating individuals, the rapid refund or the refund anticipation loan is the refund of choice.Since the advent of the computer age, and the great invention of the internet, the Internal Revenue Service (IRS) has been fairly quick to react to the benefit of electronic filing.
