| JUDGE AWARDS $25,000 IN LEGAL FEES IN MANDAMUS CASE | | 2008-07-18 10:07:14 | | A federal judge has ordered USCIS to pay attorney Kip Evan Steinberg $25,000 in legal fees after the lawyer's client sued the agency to force it to complete processing in an adjustment of status green card case. USCIS tried to point the finger at the FBI for delays in the name check process, but the judge wasn't buying. The judge found the 151 hours the lawyer put in to the case to be reasonable. | | By: Partha On Immigration | | |

Or will Bobby Bonds, the legally tangled slugger, patrol Yankee Stadium's spacious leftfield? YOU decide. Here you go..."Embattled former Giants slugger Barry Bonds has entered into formal contract negotiations with the Yankees, and a consummation of the deal is anticipated forthwith, a confidential clubhouse source told MLBNewsOnline.com.The incentive-laden deal, being hammered out between Bonds' agent Jeff Borris and general manager Brian Cashman, will well exceed the major league $200,000 minimum but has a number of protective clauses to isolate the Yankees' exposure to the possibility of Bonds missing time due to legal distractions or recurring injury, the source said. (And until he reports that Barry Bonds is climbing the Empire State Building and the Navy is dispatching biplanes, I'm sticking with my source.)Cashman was reported to have arrived at the decision to sign Bonds during the All-Star break when he determined | | By: Peter's Red Sox Forever

This will be my first time doing so and I'm really excited to be a part of this. For those that don't know what the Gaylactic Spectrum Awards are, they are awards for various categories (novels, shorts, etc.) that acknowledge works with issues or themes of interest to the LGBT community (i.e. lesbian, gay, bisexual, and transgender). For those that might think these awards are just silly nonsense, you should look into who has been nominated this year and in previous years: folks like Elizabeth Bear, Stephen Baxter, Jo Walton, T. A. Pratt, Hal Duncan, Christopher Barzak, etc. Big names and lesser-known-names have been nominated for this as well as novels from all across the board of speculative fiction (from fantasy to science fiction to cross genre, etc.).So, I'm really excited about this! Both an appellate court and the Texas Supreme Court have ruled that the children and parents must be reunified. Even now Judge Walther is blocking the reunification by attempting to get parents to sign agreements with Child Protective Services before they can be reunited with their children.
Barbara Walther's actions constitute one of the greatest violation of constitutional rights in the State of Texas and she should be impeached and removed from office. This petition will be forwarded to Texas lawmakers after enough signatures are collected.
Signing this petition does not mean that you necessarily support the FLDS and their religious views.

| | Judge thinks Harry Potter is gibberish | | 2008-04-18 07:37:47 | | Joanne Rowling, renamed JK by her publishers so that she could sound "more masculine", has had a taste of off-the-cuff judicial thinking. Judge Robert Patterson Jr, who is overseeing the copyright trial in New York, admitted that he was not a Harry Potter fan. So much so that he described Rowling's works as "full of gibberish" and "extremely complex". Not exactly sentiments Ms.Rowling wanted to hear.Although she says she is vehemently anti-censorship, she wants to censor this particular book. However, Judge Patterson suggested there was genuine worth in an encyclopaedia like The Harry Potter Lexicon, written by Steven vander Ark, that Rowling is attempting to block by claiming that it breaches her copyright. He mentioned the case of Jarndyce v Jarndyce in Charles Dickens’s Bleak House about the pain and damage of a long drawn-out suit.I can't think what she wanted to embark on such a thing for. You want to talk about government control and how a judge doesn't use the law so much as his or her own opinions when it comes to the lives of the American citizen? Let’s us focus our attention to the great state of California.
Last October, Los Angeles Superior Court Commissioner Marilyn Mackel denied 17-year-old Shawn Sage's request for early enlistment with the Marine Corps — and a $10,000 signing bonus — reportedly on the grounds that the judge didn't approve of the Iraq war.
"The judge said she didn't support the Iraq war for any reason we're over there," Marine recruiter Sgt. Guillermo Medrano of the Simi Valley U.S. Marine Corps recruiting office told the paper.
"She just said all recruiters were the same — that they 'all tap dance and tell me what I want to hear.' She said she didn't want him to fight in it."

What was the reason for this nonsensical rule of Judge Holly Hollenbeck's anway, I have to ask myself? Well it can't be due to his irrational fear that a gun would be hidden under Bev Williams' hat, since without question all people entering a federal building would have had to undergo a scanning process to eliminate threats of bodily harm to their persons. The only other plausible excuse that I can think of for this would be the evident self-love of this judge, who to his credit came to his senses. Oh wait...didn't he mention something to the effect of this case "hurting him politically as well in the next election?" It makes me sad as well as angry to think of standing before an insensitive, phony judge, who has been given the colossal responsibility of making life-changing decisions every day. Before undertaking such a task they should attend and pass sensitivity courses, since their business is humans and how to best assist them with integration in our society. | | | Judge in Britain Outlines 11 of Al Gore’s Lies That Must Be Disclosed to Students in Propaganda Film: An Inconvenient Truth | | 2007-10-10 19:14:26 | | We wrote an editorial recently regarding a Judge’s decision to require British students to receive a warning before they are shown Al Gore’s indoctrination movie, “An Inconvenient Truth.” Thankfully, the Judge’s ruling is much more extensive. He is requiring 11 of Al Gore’s lies to be exposed to the children before they see the movie. This is a great start folks."In order for the film to be shown, the Government must first amend their Guidance Notes to Teachers to make clear that 1.) The Film is a political work and promotes only one side of the argument. 2.) If teachers present the Film without making this plain they may be in breach of section 406 of the Education Act 1996 and guilty of political indoctrination. 3.) Eleven inaccuracies have to be specifically drawn to the attention of school children."1. The film claims that melting snows on Mount Kilimanjaro evidence global warming. The Government's expert was forced to concede that this is not correct.2. The film suggests that evidence from ice cores proves that rising CO2 causes temperature increases over 650,000 years. The Court found that the film was misleading: over that period the rises in CO2 lagged behind the temperature rises by 800-2000 years.3. The film uses emotive images of Hurricane Katrina and suggests that this has been caused by global warming. The Government's expert had to accept that it was "not possible" to attribute one-off events to global warming.4. The film shows the drying up of Lake Chad and claims that this was caused by global warming. The Government's expert had to accept that this was not the case.5. The film claims that a study showed that polar bears had drowned due to disappearing arctic ice. It turned out that Mr Gore had misread the study: in fact four polar bears drowned and this was because of a particularly violent storm.6. The film threatens that global warming could stop the Gulf Stream throwing Europe into an ice age: the Claimant's evidence was that this was a scientific impossibility.7. The film blames global warming for species losses including coral reef bleaching. The Government could not find any evidence to support this claim.8. The film suggests that the Greenland ice covering could melt causing sea levels to rise dangerously. The evidence is that Greenland will not melt for millennia.9. The film suggests that the Antarctic ice covering is melting, the evidence was that it is in fact increasing.10. The film suggests that sea levels could rise by 7m causing the displacement of millions of people. In fact the evidence is that sea levels are expected to rise by about 40cm over the next hundred years and that there is no such threat of massive migration.11. The film claims that rising sea levels has caused the evacuation of certain Pacific islands to New Zealand. The Government are unable to substantiate this and the Court observed that this appears to be a false claim.(source)Now we can wait for Al Gore the charlatan to accept his Nobel Peace Prize. COPE began its investigation in August 2006 and prepared a report in four months on 26 government institutions which alleges mismanagement of over a staggering Rs.150 billion.â€It is reported that majority of the corruption takes place in institutions such as the Ceylon Electricity Board (CEB) which is accumulating a monthly liability of Rs.1.5 billion. Others include the Board of Investment (BOI), state banks, and the Water Board. By far the greatest disaster detailed in the COPE report was the privatization of Sri Lanka Insurance Corporation (SLIC) in 2003. The chairman of the COPE himself has humbly and honestly admitted in his speech in Parliament, referring to the Parliamentarians in the first person: ‘This report is an indictment on all 225 of us who are here. It is not because we have all robbed the country, but because we are the Custodians of Public finances and we have failed to do our duty in this regard over the years.’While Sri Lanka is fortunate to have the present leadership of the COPE that takes a laborious effort to look into the affairs of some vital public institutions, the Executive branch of the State has so far failed to take any meaningful action to probe into the findings of the COPE report. It is in this backdrop that recently it was reported that COPE chairman Wijedasa Rajapakse has been criticized heavily in last Cabinet meeting. So far the government has failed to take any noticeable action against those clearly pointed out in COP report; rather it is now running after the COPE chairman himself. It is a shame to have bunch of this type of politicos in this country. They are not only a set of shameless pigs stealing peoples money, now they are trying to hunt the COPE chairman for disclosing their dirty acts.Further there are serious allegations that MPs are changing sides for monetary or other benefits. It is not only the politicos, but there are herd of businessmen behind these goons as well. We all know who bought the Sri Lanka Insurance Corporation (SLIC) who is the owner of distilleries co-operation, LankaBell and Appalo (Sri Lanka) Hospital. These horrible businessmen and politicos are still roam in the political arena as pretending as gentlemen. But the reality is they are mere moving rotten trunks stinking this society. If the government is not taking any action, it is the duty of the people of this country to spit on their faces.Read COPE report here.. | | By: Lanka Rising
| | Judge Martin Jenkins Temporarily Saves the World: Dismisses Dangerous Global Warming Lawsuit | | 2007-09-18 05:21:18 | | With all the insanity we have in our Court system, thankfully we have a few sane Judges to protect us from the extortionists. Evidently, even in San Francisco we can find a qualified Judiciary. Just recently, Federal District Court Judge Martin Jenkins temporarily saved the world by dismissing a lawsuit brought by the State of California (Let’s wait for the Appeal).Who were they suing? They sought to hold the world's six largest automakers accountable for their contribution to global warming. “California blamed the auto industry for millions of dollars it expects to spend on repairing damage from global-warming induced floods and other natural disasters.” This is getting really scary. While the American people have become complacent with the numerous lawsuits around the United States, suits for causing global warming are the most dangerous forms of extortion. They are the most dangerous because anyone at any time is liable. There is no way to prove one way or another what was | | By: Copious Dissent - Your Daily Dose of Liberty | | |
| | Kentucky Judge Ponders TownÂs Restaurant Tax | | 2007-09-12 07:00:00 | | Attorneys in Elizabethtown, Kentucky argued yesterday that the town's proposed restaurant tax violates the state constitution. Legally, restaurants would be responsible for paying the tax, but because all taxes are eventually paid by individuals, the tax will be just a way to tax consumers while hiding the burden. Further, the money will be used to "encourage tourism," as if raising restaurant prices won't reduce all business, tourist or not.A provision of the 1891 state constitution stated that towns up to a population of 7,999 can enact a restaurant tax, though that part was narrowly repealed in 1994, on condition that it remain in effect until the state legislature replaced it with alternative criteria. The state legislature never did so, and because Elizabethtown's population is 23,450, restaurant owners say that it cannot impose the tax. They had tried and failed to get the City Council to amend the law.The Elizabethtown News-Enterprise has an online poll today a | | By: Tax Policy Blog | | |
| | Judge strikes down part of Patriot Act | | 2007-09-07 14:45:24 | | From the AP: Judge strikes down part of Patriot ActA federal judge struck down a key part of the USA Patriot Act on Thursday in a ruling that defended the need for judicial oversight of laws and bashed Congress for passing a law that makes possible "far-reaching invasions of liberty." U.S. District Judge Victor Marrero immediately stayed the effect of his ruling, allowing the government time to appeal. Justice Department spokesman Dean Boyd said: "We are reviewing the decision and considering our options at this time." The ruling handed the American Civil Liberties Union a major victory in its challenge of the post-Sept. 11 law that gave broader investigative powers to law enforcement. The ACLU had challenged the law on behalf of an Internet service provider, complaining that the law allowed the FBI to demand records without the kind of court supervision required for other government searches. | | Iowa Judge Rules Gay Marriage Legal | | 2007-09-01 05:07:53 | | From The Nation via Yahoo: The Nation -- Iowa will in all likelihood remain the state that opens the process of nominating the Democratic and Republican candidates for president in 2008. As such, it is a "must visit" and "must impress" state for contenders in both parties. Iowa is now something else, however. With the decision of a county judge to strike down Iowa's law banning same-sex marriages, the state becomes a front-line battleground in America's ongoing political wrestling match over gay and lesbian rights. When Polk County Judge Robert Hanson concluded that the state's prohibition on same-sex marriage is unconstitutional and ordered the county recorder in Des Moines to issue marriage licenses to six gay couples, he did not merely give an unexpected courtroom victory to plaintiffs likes Iowa City's Jen BarbouRoske, who declared Thursday, "This is kind of the American Dream." Hanson also reshaped the presidential races of both parties. Democratic and Republicans candidates will | | By: Dyre Portents | | |
| | Government must pay fair share of property taxes: judge | | 2007-09-01 00:30:00 | | OTTAWA - In landmark decisions that could have repercussions for cities and towns across the country, a Federal Court judge has ruled that the federal government and its Crown corporations have a duty to pay their fair share to municipalities for the properties they own. In three cases that pitted the City of Montreal against the federal government and two of its Crown corporations, Justice Luc Martineau ruled that federal officials cannot arbitrarily decide how much they will pay the city, and overturned decisions by bureaucrats to pay the city considerably less than the city would have received from a private property owner.

| | No Special Treatment from Judge in Vick’s Case | | 2007-07-20 17:18:07 | | For those out there that want no special treatment given to Falcons QB Michael Vick when it comes to being in front of a judge, it appears you are going to get your wish. U.S. District Judge Henry E. Hudson will be hearing the case on Vick, and according to sources he is not one to be impressed by someone like Vick’s celebrity status or loads of cash that will secure him some of the best lawyers in the country.
“Trial lawyers love to appear in his court because he lets the lawyers try their case,” defense attorney and former prosecutor William J. Dinkin of Richmond told the Associated Press. “Everyone is going to get their fair shake. He’s a very evenhanded trial judge.” Hudson is reportedly known for handing down stiff sentences and letting the lawyers present their cases in a fair manner. “He’s straight forward, a straight shooter,” said Carl Tobias, a law professor at the University of Richmond. “You don’t get any spe | | By: NFL GridIron Gab
| | Idiocracy. Mike Judge. | | 2007-07-06 17:29:12 | |
Idiocracy has one fundamental flaw--and plenty of little ones, but the fundamental one is too glaring and too fixable--the two leads do not have a romance and the film pretends they do. Foul-mouthed prostitute Maya Rudolph all of a sudden starts talking without slang and doing sweet things. Then, at the end, there's supposed to be some romantic connection between her and Luke Wilson, who spends the movie thinking she's a painter (one who's really scared of her art manager). The romantic element isn't part of Idiocracy because it doesn't fit with what Mike Judge is trying to do (which is to mix Sleeper with some Fight Club cynicism--with a handful of fart jokes) and so he avoids it. But in the end, when Rudolph is finally acting--Wilson acts the whole time--the mix needs to work and it doesn't and Idiocracy goes out with a whimper. The ending is similar to a 1960s educational film reel about... moths or something. It doesn't just stop, it crumbles away.

| | Pennsylvania Judge Strikes Down Property Tax System | | 2007-06-18 07:00:00 | | There are many stories in the news about property taxes lately. To raise this important source of local revenue, counties and states have varying ways of assessing land and improvements for tax purposes. Allegheny County, Pennsylvania, uses a "base year" (2002) for calculating taxes, so changes in value from 2002 to 2007 are not considered. With the recent fall-off in housing prices, this has created disparities within the county. For example, in Edgewood borough, prices have risen by 36% since 2002, while in the neighboring Pittsburgh suburb of Braddock, prices have fallen by 16% over that same period. But property owners in both boroughs pay taxes according to 2002 values. But on June 6, a Pennsylvania judge ruled that the system violates the state constitution: Assessment laws that allow the use of a base year assessment without requiring reassessments violate the Uniformity Clause because (1) base year assessments are not intended to assess all pr | | By: Tax Policy Blog | | |
| | Guardians! What an Outrage! From Judge to Ward of the Court! | | 2007-06-15 14:30:00 | | Article adopted from Your Life What an Outrage! From judge to ward of the court!By Christopher Ketcham June 2007 AARP Bulletin John L. Phillips was once a respected and wealthy Brooklyn, N.Y., judge. But today, the retired jurist, 84, is in an assisted living facility and his $10 million estate is in disarray.Phillips, who has no direct heirs, lost control of his life in 2000 when the office of Kings County District Attorney Charles Hynes requested proceedings in which Phillips was diagnosed with early Alzheimer's and declared incapacitated. The court appointed a guardian to conduct his business.Hynes, whose seat Phillips sought to challenge in 1997, started guardianship proceedings, saying that the judge "appeared disoriented and uncared for." He denies he or his staff sought to place the judge in a "retirement home." But Phillips' friends and neighbors claim Hynes had ulterior motives: the judge was considering another run against the DA in 2001 and posed a threat to Hynes.A series | | By: Elder Abuse | | |
| | | Our Worst Judge | | 2007-06-04 20:54:00 | | It is astonishing to read Justice Ginsburg's dissent in the narrowly decided LEDBETTER v. GOODYEAR TIRE & RUBBER CO., INC. in which the plaintiff tried to sue over sexual discrimination nearly 18 years after the alleged discrimination took place (federal law has a statute of limitations of 180 days). Ginsburg shows no respect for the law or the Constitution as it is written. Her fiery decisions are almost always proclamations in defense of the so called disenfranchised (which in her case includes all those who are not white men). Moreover, she shows utter disrespect for the unambigous language of the statute, the legislative intent, and she is instead more concerned with her own ideological goals. It is worth noting that Justice Ginsburg while a sitting DC Circuit Court Judge not once hired a single black person (out of 50). Though being a limousine liberal, this never stops her from pushing for court ordered quotas to correct what she sees as racial imbalance in the workplace even | | By: Copious Dissent - Your Daily Dose of Liberty | | |
