Ashley Dupré Drops Lawsuit Against Joe Francis
    2008-07-07 11:11:58
The famous prostitute, Ashley Alexandra Dupre that was most known for her involvement with Governor Eliot Spitzer when he was brought down has reportedly dropped her lawsuit against Girls Gone Wild CEO Joe Francis. When she filed the lawsuit back in April, she claimed that Girls Gone Wild used her name for profit and that she was manipulated into giving her consent for the video she appearted in, however, Francis insisted he had video evidence to prove otherwise. Francis told TMZ:"The filing of the lawsuit was a serious lapse of judgment on her part. I never did understand how I could possibly damage the reputation of a hooker ... This isn't the first time I've faced false allegations against me. But the truth invariably comes out, as I knew it would in this case. I am happy to, once again, be completely vindicated."Dupre's attorney issued a statement:"Ms. Dupré wants to eliminate all negativity from her life and focus on the positive. Fisker's request for arbitration granted in Tesla lawsuit
    2008-06-14 03:58:00
A few months back, Tesla Motors sued Fisker Automotive for allegedly stealing information related to the production of its upcoming plug-in electric sedan named Whitestar and using it to develop its series-hybird, the Karma. Yesterday, a judge ruled in favor of Fisker Automotive by allowing the case to go into arbitration outside the courtroom, which was apparently part of the original agreement between Tesla and Henrik Fisker in the first place. It appears that Tesla went outside that original agreement by bringing forth its lawsuit in the first place, though Tesla may have considered that contract void as the original lawsuit alleged that it was signed merely to gain access to confidential information.Although the arbitration is to be handled outside of court, the judge has scheduled a management conference this August, perhaps to be sure that negotiations are moving along. This is good news for Fisker, which is currently working to get its Karma PHEV sedan to market by the fourth-qu

If history means anything, this Nutley PD lawsuit will turn out to be nothing short of an act of frivolity
    2008-06-02 20:05:00
If you've ever met John Holland, you know, as I do, that he's just one of the nicest guys you'll ever meet. He epitomizes what a police chief should be — and even better, he epitomizes what those of us who are Jesuit educated call a true "Man For Others." No matter what it is, Holland is ready to help his fellow human quicker than most people would. So, when I learned today there was a woman suing the Nutley Police Department over alleged brutality, and over a lack of action on the part of the Nutley Police Department, I couldn't think anything other than wow — this has to be some sort of act of futility on the part of the "plaintiff" if you will.As a journalist, I've had the good fortune of getting to know Holland well beyond the auspices of being a member of the press who happens to cover the Nutley Police Department. And so far as I know, there has never been a more accessible and open police chief whom I've dealt with — ever. Whenever there is a breaking news story, he ensures

Magna files lawsuit against Tesla Motors
    2008-04-16 23:44:23
Magna files lawsuit against Tesla Motors Just yesterday we reported that Tesla Motors has filed a lawsuit against Fisker Coachbuild, but now comes word that Tesla could be in some legal trouble of its own. Magna — a transmission maker — has filed a suit against Tesla for money it says the electric carmaker still owes it. During the development of the electric Roadster, Tesla ran into some development problems with the car's transmission. The car was originally slated to get a two-speed unit supplied by X-Trac, but that unit had durability issues so Tesla turned to Magna. Tesla subsequently decided not to use the Magna unit and developed its own before eventually deciding on a single speed unit (ultimately the car's electric motor had to be altered). According to AutoblogGreen, Magna isn't upset that Tesla decided not to go with its design, but rather that Tesla never paid them fully for its work — $5.6 million in all.

Toxic Tort Lawsuit Filed Against IBM
    2008-01-24 08:23:00
Nearly 100 residents of Endicott—the birthplace of IBM—and the neighboring town of Union have filed a toxic tort lawsuit against the company, claiming that contamination from a local IBM plant caused health problems and property devaluation.Decades of Contamination"This is contamination involving toxic contamination in the groundwater that then through vapor intrusion got into people's homes. And it's contamination we believe has been there back into the 1960s," said attorney Stephen Schwarz. However, the contamination was not known until 2003 and now the contamination is being cited as the source of cancer, birth defects and other ailments suffered by local residents.Compensating Victims Attorneys for the plaintiffs say they "have one simple goal, to get reasonable compensation for the injuries our clients have sustained."More lawsuits against the company are expected to follow in the coming months on behalf of about 900 Endicott and Union residents.

Lawsuit prevents MS from talking about Live's status - SendMeRSS

Lawsuit prevents MS from talking about Live's statusFiled under: News, Xbox LiveSpeaking about the issue in his latest podcast, Major Nelson talks about Xbox Live still acting wonky and why he and Microsoft can no longer update the gaming community on the service's status. And it should come as no surprise that it's because of legalities.Major Nelson says that he and Microsoft haven't talked about or updated Live users about the Xbox Live service lately, because they are legally gagged. Currently, there's an Xbox Live outage lawsuit taking place in Texas (concerning the Live down time last December) and because of that, Major has to be shush about all things concerning the status of the Xbox Live service. No more blog updates, Twitter updates or comments. We'll be pretty much in the dark if anything should go wrong with Live until the Texas lawsuit is over. According to Major Nelson's most recent podcast,  the pending status of the suit is forcing Microsoft to keep hush about any progress being made with the Live repairs.  "I can't say anything so I apologize, but go talk to the lawyer...That's all I can say about that." ADA Consulting Firm Aims to End Cycle of ADA Lawsuit Abuse
    2008-01-03 04:20:00
ADA Compliance Review Corp., an ADA consulting company, has introduced their 'Compliance Assurance' program in response to the tidal wave of Disabled Access lawsuits. Now their clients can maintain ongoing compliance with the Americans with Disabilities Act and avoid lawsuits. Under the new program the Company will send an ADA compliance specialist to the client's site every 3 months.Under the ADA and California law, a business that is open to the public must have designated parking and no steps or curbs blocking an entrance. Bathrooms and aisles must be able to accommodate customers with wheelchairs and counters cannot be too high. The law allows a disabled person who has been denied access to a public building because of access violations to file a lawsuit.According to Philippe Heller, president of ADA Compliance Review Corp., "Once the parking lot paint fades or the disabled parking signs get knocked over or damaged by graffiti, the business is again subject to an ADA lawsuit. Through the 'Compliance Assurance' program a business owner won't have to worry. We will perform quarterly spot inspections to ensure ADA compliance and protect them from shakedown lawsuits."Many business owners are under the false impression that they are "grand-fathered" due to the age of the building. Heller points out that regardless of age all commercial buildings are subject to some level of compliance. With the law's exacting standards, violations are easy to find. "Our reports recommend the easiest and least expensive way to become ADA compliant. Compliance can often be accomplished without spending much money. And tax breaks exist for most businesses."ADA Compliance Review Corp. provides business and commercial property owners with affordable ADA inspection services and signs. Their investment in state-of-the-art reporting software and equipment has contributed to the rapid growth of the Company. Pennsylvania Woman Wins Toilet Paper Tax Lawsuit
    2007-12-03 00:00:00
Back in October, we reported on Mary Bach, a Pennsylvania woman who sued K-Mart because her $3.99 toilet paper purchase was incorrectly taxed (for 28 cents). The Associated Press reports that Ms. Bach won her lawsuit, and under Pennsylvania's consumer protection law, K-Mart must pay $100 (357 times Ms. Bach's actual damages). Recovering illegally collected taxes is certainly laudable, but K-Mart seems caught between a rock and a hard place, as we previously noted:Some 7,400 jurisdictions in the United States impose a sales tax, and most if not all of those taxes carve out exemptions and exceptions for politically-favored products. Keeping track of what's taxed and what's not in 7,400+ tax codes is a tough job, and if you mess up, you face fines and lawsuits. For instance, the following items are among those exempt from Pennsylvania's sales tax: wrapping paper, toothbrushes, coal, coffins, horses (but only if shipped out-of-state or used for commercial racing), three kinds of tr

    Frivolous Lawsuit of the Day
    2007-11-30 12:25:00
This is so stupid and wrong I don't even know what to say. Without seeing the actual text of the lawsuit it's tough to comment on the (lack of) logic here, but I gotta say I'm baffled that any lawyer would take this case. Here's the text of the article for those who don't want to click the link: MILWAUKEE - Just days after a Washington D.C. judge lost his job following the loss of a $54 million lawsuit over a pair of missing pants, a Milwaukee business is being sued in what legal observers describe as an equally frivolous case.A Florida man, Olester Duncan, has named a handful of breweries including Milwaukee’s Lakefront Brewery seeking damages after he got knocked in the head with a can of Schlitz Malt Liquor.Duncan claims he was reaching for a four-pack of the brew at an Albertson’s grocery store in Ocala, Florida, when one can came loose and hit him in the skull.Although Lakefront Brewery is named as a defendant, there is no explanation in court documents why Mr. Duncan believes Lakefront is responsible.“I don’t know what his injuries were,” said Lakefront’s attorney, Don Demet. “But maybe he got hit in the head and there were injuries to his thought process or something.”TODAY’S TMJ4 placed numerous calls to Mr. Duncan’s attorney, Dennis L. Finch, but none of those calls was returned. The president of Lakefront Brewery, Russ Klisch, said he was dumbfounded when the summons arrived.“It just doesn’t seem possible that somebody could be hit on the head with a can of beer in Florida, and it wasn’t even your beer, and you could be sued,” Klisch exclaimed.Though some legal observers are chuckling about the seemingly frivolous lawsuit, Duncan’s wife, Maria, is not laughing. The lawsuit claims she’s suffered “the loss of the value of her husband’s services, society, companionship and consortium by reason of his injuries.”Klisch has liability insurance for his business and has turned the matter over to his insurance company’s l

Judge Martin Jenkins Temporarily Saves the World: Dismisses Dangerous Global Warming Lawsuit
    2007-09-18 05:21:18
With all the insanity we have in our Court system, thankfully we have a few sane Judges to protect us from the extortionists. Evidently, even in San Francisco we can find a qualified Judiciary. Just recently, Federal District Court Judge Martin Jenkins temporarily saved the world by dismissing a lawsuit brought by the State of California (Let’s wait for the Appeal).Who were they suing? They sought to hold the world's six largest automakers accountable for their contribution to global warming. “California blamed the auto industry for millions of dollars it expects to spend on repairing damage from global-warming induced floods and other natural disasters.” This is getting really scary. While the American people have become complacent with the numerous lawsuits around the United States, suits for causing global warming are the most dangerous forms of extortion. They are the most dangerous because anyone at any time is liable. There is no way to prove one way or another what was
