    Federal Gas Tax Holiday Wouldn't Apply to Nevada, California, Oklahoma and Tennessee

    Even if the federal gas tax holiday was implemented, it would not apply (fully) to gasoline sold in four states. That's because California, Nevada, Oklahoma, and Tennessee each has a provision in the state's tax law which states that if the federal gas tax is lowered, that state's own gas tax will increase by some amount. This is theoretically designed to maintain transportation spending in the state.Here is a link to a Taxadmin.org page citing the provisions of the four states. It will be senior day for Chris Lofton who has arguably been the face of Tennessee basketball - other than Bruce Pearl - during this resurgence. It will also be Dave Odom's last SEC regular season game as he is "retiring". Maybe Bruce Pearl will have some sympathy for Odom in his game. Probably not. Florida is struggling coming down the stretch going just 5-5 in their last 10 and needs a win to cement its NCAA status. In their win over Kentucky, Tennessee showed how much it struggles at times when forced to play half court offense consistently. I look for Billy Donovan to slow it down and milk the shot clock. Florida really struggled shooting the ball in their last game, a loss to Miss State, shooting just 36%. If the Gators try to run with Tennessee they don't have much of a chance. I like Tennessee to win this one in Gainesville.Prediction: TennesseeTennessee Florida lineThis one will be tight with it being in Gainesville.     We've written that sales tax holidays are poor tax policy:First, sales tax holidays are distortionary because they are non-neutral across products. This means that consumers have an incentive to buy products which fall under the sales tax holiday as opposed to goods that are not covered in the holiday.Second, sales tax holidays are non-neutral over time, which means that they create incentives for consumers to purchase items during the sales tax holiday that they otherwise would have purchased at another time. Additionally, sales tax holidays add to retailers' compliance costs and make the tax code less stable. Back in January, Kentucky's season turned when they defeated the Vols in Lexington by 6 - Patterson had a team high 20 points. Tennessee should come out fired up after their loss to Vanderbilt on Tuesday who ended their reign atop the polls before the ink was dry. I like Tennessee to come out pressing on defense, attacking on offense with the 3, and trying to repeat what Vandy did to Kentucky a few weeks back by embarrassing Kentucky. For Kentucky to have a chance in this game, they need to whether to storm early and slow it down to a half court game. They will have to shoot well from 3 and have a big game from the senior backcourt of Joe Crawford and Ramel Bradley. In the end, I like Tennessee as they have too much talent and will have the Knoxville crowd in a frenzy just a few minutes into the game.Prediction: Tennessee

The Vols have 9 in a row since losing at Kentucky and have covered in 4 of their last 5. The last time these two met, the Commodores shot just 3-14 from 3 pt and 37% total from the field. Throw in 21 turnovers and you can see why Vanderbilt lost by 20. Vanderbilt is undefeated at the funky Memorial Gym in Nashville this year. Bruce Pearl has said all the right things this year and pressed the importance of the next game being the most important. The Commodores have had some close calls against not so good opponents (Auburn, South Carolina).     Tennessee @ MemphisNumber 1 vs Number 2, Battle of Tennessee, Calipari vs Pearl...all comes together at the FedEx Forum on Saturday night at 9PM on ESPN. These two teams play very similar styles of basketball - they like to run 'n gun, press, shoot the 3, and are not very good at the free throw line. Bruce Pearl and John Calipari have a had chilly relationship in the past, but both are mum on their teams chances and how important this game is. I think Tennessee wins by neutralizing Memphis' bigs and getting Chris Lofton going early from the outside.     Florida Tries to Upend Tennessee

The only blemish in the Vols last 10 games is a road loss to resurgent Kentucky. Florida was embarrassed in its last game against Arkansas. Billy Donovan's club is much more comfortable in Gainesville, especially on offense where they shoot just 41% from the field and 29% from 3 point land away from the O-Dome. This plays right into Bruce Pearl's hands as the Volunteers allow just 41% from opponents at Thompson Boling Arena. Florida likes to play up tempo, but they cannot compete with Tennessee in a shootout. For the Gators to win, they have to make Tennessee play half court offense where they are much less effective. If Florida is going to win, they have to keep the Vols under 80 points. I do not think Florida plays good enough defense to do this and they will lose after putting up a valiant effort.     East Meets West as Tennessee Travels to Mississippi State

    Kentucky @ GeorgiaAfter a rough start to the season for the Wildcats, they have ripped off 2 straight wins over SEC East rivals Tennessee and South Carolina. Kentucky comes into this game with a full week to prepare for a Georgia team who has lost its last 2 to those same teams. The Bulldogs main offensive weapon, Billy Humphrey, has been battling a knee injury for most of the year and said after the South Carolina loss it was a reason for his subpar play. If Humphrey can battle through the injury then Georgia has a great chance at home where they are undefeated this season. The Wildcats are 0-4 away from Rupp Arena and shoot just 42% from the field as compared to 47% in Lexington. Kentucky absolutely has to have this one if they want to make a serious run at the NCAA Tournament. Tennessee is the class of the SEC this year and shows no signs of slowing down at home. Watch for how Tennessee guards Georgia G Billy Humphrey. Humphrey is a threat to score from anywhere on the floor, but after him the Bulldogs are pretty mediocre on offense. Tennessee's pressure may force Georgia be more up tempo than they want and not allow Humphrey to work in the half court.     Tennessee's Excise Tax on Illegal Drugs Ruled Unconstitutional

    Tennessee is one of twenty states that impose a tax on illicit drugs, at a rate of $3.50 per gram of marijuana, $50 per gram of cocaine, and $200 per gram of other controlled substances. We've previously noted that these "drug stamp taxes" or "crack taxes" became popular in the 1980's as an easy way for states to raise revenue from dealers and users who had plead guilty to drug offenses, since few pay the tax before they are arrested; convictions are not needed to levy the tax, and the burden of proof is lower.  Tennessee raised $1.8 million last year from the tax.Today, the Tennessee Court of Appeals ruled that the tax is unconstitutional, exceeding the legislature's taxing power. From the introduction of a bill to tax pornography as a means to somehow replace the tax on food to the passage of a cigarette tax hike to pay for general spending on education or even veterans' benefits, the legislature is not always a model of good fiscal policy. And now we see that the Volunteer State has called for a special tax provision for the owner of Graceland. The execution, the first since the state reviewed and revised its lethal injection procedures, came after a flurry of appeals from Mr. Workman’s attorneys, who unsuccessfully sought stays from the U.S. Supreme Court and the Tennessee Supreme Court. Good, Tennessee came to their senses, maybe they’ll start to clear out their death row now… To me, the only thing cruel or unusual about the death penalty is the way it tortures the family of the person that was murdered by the slime-ball being executed, WHY should these families have to wait, in some case, literally for years before they see justice for their loss??
