Al-Arian , who pled guilty in 2006 to conspiring to provide goods and services to the Palestinian Islamic Jihad, has argued that his plea agreement ruled out any cooperation with the government. | Virginia Holds Legislative Special Session on Transportation Taxes | | 2008-06-22 23:00:00 | | Back in February, the Virginia Supreme Court invalidated seven regional taxes levied by the unelected Northern Virginia Transportation Authority (NVTA). Government officials reacted predictably-they proposed re-imposing the taxes statewide, and threatened to cancel most transportation projects unless it happens. It's not quite as bad as when Michigan threatened to stop burying people unless voters hiked taxes, but still a more palpable threat than the famous warning that the Washington Monument would have to be shut down if the Park Service budget was cut.Virginia Governor Tim Kaine (D) has a list of ideas for $1.1 billion in new taxes, which will be debated beginning today at a week-long legislative special session. Kaine's plan includes a 1 percent increase in the state sales tax in Northern Virginia and Hampton Roads (to 6 percent), a new 1 percent tax on the sale of automobiles, a $10 increase in annual vehicle registration fees, as well as a 25 cent increase in grantor's tax (to | | By: Tax Policy Blog

| Clinton Wins West Virginia | | 2008-05-14 20:18:41 | | Not that anyone expected anything different given the demographics...From the AP:As expected, roughly 95 percent of West Virginia Democratic primary voters were white. Half of voters were from rural areas. It was one of the oldest electorates among 31 Democratic primaries with exit polls to date, with four in 10 over age 60. The only other states with somewhat similar numbers were Arkansas, Arizona, New Mexico and Oklahoma — and Hillary Clinton won all four states. It also was the electorate with the highest proportion — just about seven in 10 — of people who lack a college degree thus far this primary season. The same held true for whites without a college degree — again, historically a strong Clinton group. According to CNN Clinton picked up nine pledged delegates. Which still leaves Obama with a triple digit lead. Whats more telling is that Obama now has a nine superdelegate lead over Clinton which means all totalled he has a 168 delegate lead over Clinton and if you've been r | | By: Dyre Portents | | |

Notes[6:39PM CST] As expected, Clinton has been declared the winner in West Virginia already. Some supporters were suggesting she could bring in as much as 90%. While that seems like expectations gone wild, a romp is no doubt in the works. What margin of victory does she need to change the thinking that this race is over? Will any margin of victory do that? But there's probably a better way to do it than the administrative mess associated with blanket temporary tax holidays. | [Wikipedia] April 16: Virginia Tech massacre | | 2008-04-15 23:01:37 | | The Virginia Tech massacre was a school shooting comprised of two separate incidents about two hours apart on April 16, 2007, on the campus of Virginia Tech. The shooter killed thirty-two people and wounded twenty-three others before committing suicide, making it the deadliest shooting in U.S. history. The perpetrator had been court ordered to seek treatment at the university's Cook Counseling Center seventeen months earlier, but the order was neither obeyed nor enforced. Additionally, the university's administration had failed to heed warnings from the shooter's professors on numerous occasions. The incident sparked intense debate in the U.S. and globally about gun violence, gun laws, gaps in the U.S. system for treating mental health issues, the perpetrator's state of mind, the responsibility of college administrators, privacy laws, journalism ethics, and other issues. | Virginia Announces Process for Refunding Illegal NVTA Taxes | | 2008-04-13 23:00:00 | | Following February's Virginia Supreme Court ruling invalidating seven taxes collected by the Northern Virginia Transportation Authority, Governor Tim Kaine has signed a bill setting up a refund process for those who paid the illegal taxes. | Virginia Space Resupply Exemption Raises Policy, Legal Concerns | | 2008-03-30 23:00:00 | | The Harrisonburg (Virginia) Daily News reports on a bill signed earlier this month which exempts income earned from space launches or space resupply services from corporate and individual income taxes, so long as the services supply missions are launched from Virginia: The legislation amends the state tax code so that, starting in 2009, no tax would be charged on revenue from commercial human spaceflight launch services and training, or space resupply services, provided those launches take place from a facility in the state. The fiscal impact statement for the legislation notes that the impact of the tax exemption "is unknown, but likely minimal,"because of the lack of activity in this sector. While there may be a lack of activity now, there could be a great deal of activity in the future. Promising tax-free takeoffs is one way to help promote such space ventures. It doesn't hurt to plan ahead. Besides, the name "Virginia Space Port" has a nice ring to it. | | By: Tax Policy Blog

| Georgia Tech Virginia Preview | | 2008-03-04 22:01:46 | | Virginia @ Georgia TechThe Cavaliers and Yellow Jackets try this one again after a leaky roof rained them out a few weeks back. The best both teams are playing for at this point is a NIT berth. Georgia Tech beat Virginia in Charlottesville in OT in their other meeting this season. Jacket PG Matt Causey should be in uniform tonight after suffering a mild concussion against Duke last Wednesday. It is a pretty simple formula for Georgia Tech to win. If they can keep their turnovers under 16 and the FT margin less than 10, then they have an excellent chance to win. Look for D'Andre Bell to stick Virginia's Sean Singletary on defense most of the night. I like Georgia Tech in this as they look to start a mini winnning streak.Prediction: Georgia Tech Georgia Tech Virginia LineThis is a tough one to figure out because I am not sure how much advantage to give GT at home considering they are below .500 on the year. | Duke Virginia Preview | | 2008-03-04 21:49:31 | | reuters/yahooDuke @ VirginiaThe Blue Devils biggest obstacle in this matchup will be looking ahead to North Carolina on Saturday night. The Cavaliers are coming off a hard fought road game on Monday night and have to turn around in 48 hours and play one of the most fundamentally sound teams in the country. Look for Duke to try and exploit Virginia's legs with a lot of pressing and fast break offense. Virginia's biggest weapon, Sean Singletary, will need to have a huge game in his second to last home game in Charlottesville for the Wahoos to pull this one off.Prediction: DukeDuke Virginia Line/Spread Is Duke just a 2 or 3 loss ACC team? Well it looks that way unless Virginia can pull off the miracle. I think Duke wins this one 8 times out of 10, so I put them at around -400, but would go up to as high as -450. | Georgia Tech Virginia Tech Weather Watch 2008 | | 2008-02-22 22:10:33 | | si.comGeorgia Tech @ Virginia TechI would think Paul Hewitt has a right to be mad. In his team's last game they turned the ball over a season high 22 times and lost by 1. Then on Thursday, a home game with Virginia was canceled due to a leaky roof. Nevermind that Georgia Tech is paying their former football coach $1M per year for nothing. The Hokies have a distinct honor in the ACC; they are the only team to lose to Tech in Atlanta. The Yellow Jackets have been very good on the road though. Virginia Tech needs good wins like they had against Maryland and more importantly must hold serve at home. For Georgia Tech to win they need to take care of the ball (15 or less turnovers) and play good perimeter defense where they have lacked most of the season. Logic would say Virginia Tech is the better team and they are at home, but I like Georgia Tech to pull this one off on the road.Prediction: Georgia TechVirginia Tech Georgia Tech lineThe Hokies will be the favorite in this game and w | | By: ACC SEC Blog | | |

| Can Georgia Tech Sweep Virginia? | | 2008-02-20 20:57:10 | | AP/YahooVirginia @ Georgia TechYes, I would be shocked too if I was Paul Hewitt and I had the chance to sweep an ACC team this season. It has been and up and down (and up and down) season for Tech. The Yellow Jackets have lost their last 3 games including a 1 point loss to Miami last Sunday giving the Hurricanes a sweep of their own for the season. For Georgia Tech to pass on this favor to Virginia they have to take better care of the ball on offense. The Jackets had a season high 22 turnovers last Sunday to Miami. The last time UVA and GT met, Georgia Tech forced overtime late and then dominated the extra period. Senior Matt Causey led the way and will have to play a big role in this game as well. Another mystifying aspect to Tech's season is their poor home record - they have just 1 ACC home win and are below .500 on the season (5-6). I think Georgia Tech plays better defense and gets into a rhythm from the outside to take this one in Atlanta.Prediction: Georgia TechGeorgia T | | By: ACC SEC Blog | | |

| Why is Hillary trying to steal Obama's Virginia delegates? | | 2008-02-19 14:29:00 | | If this report from Talking Points Memo has any truth behind it, Clinton could be trying to go after Obama's pledged delegates (NOT super delegates, but delegates who are supposed to represent OUR vote), including the 54 Obama won in Virginia's primary last week.
Via Roger Simon at Politico:
Hillary Clinton’s presidential campaign intends to go after delegates whom Barack Obama has already won in the caucuses and primaries if she needs them to win the nomination.
This strategy was confirmed to me by a high-ranking Clinton official on Monday. And I am not talking about super delegates, those 795 party big shots who are not pledged to anybody. I am talking about getting pledged delegates to switch sides.

"The concept of taxation with representation is as American as apple pie," said paper author and Tax Foundation tax counsel Joseph D. Henchman. "The Northern Virginia Transportation Authority is an unelected body that has imposed $326 million in stealth taxes. Virginia requires tax increases to be passed by a popular vote for a reason, and these types of taxpayers protections should, and legally must, be protected."Voters had on several occasions previously rejected the types of taxes imposed by the Northern Virginia Transportation Authority (NVTA), but legislators simply imposed them anyway. | Voting today in Virginia | | 2008-02-12 15:01:00 | | I voted today around 1:30pm at the Wilson School in Rosslyn. I was number #465 to vote and didn't have to wait but a couple minutes. However, my friend in Ballston voted this morning and said there were about 300 people in front of him and he waited just under two hours to be able to vote.

| Yes, Virginia, There is a Recession | | 2008-01-22 13:07:14 | | Probably because it sounds so much like “recess,” the word “recession” doesn’t scare me. Whenever I hear someone say the word I begin daydreaming about being a kid again, climbing monkey bars on a playground and “accidentally” knocking the other kids down. Good times, good times.

| Virginia Bicyclist Hit With ÂAbusive Driver Fee Tax | | 2008-01-21 00:00:00 | | We've been following Virginia's new tax on traffic offenses, which went into effect January 1. They are another example of legislators targeting random activities for punitive taxation, solely to raise revenue. Other recent examples include cigarettes, alcohol (to fund public transit), bottled water, and even video games (to fund juvenile detention facilities). Because the purpose of the surcharges is to raise money, rather than deter behavior or recoup the cost of administration, they are rightly called taxes, not fees. And they aren't small; a pregnant woman rushing to the hospital (57 mph in a 35 mph zone) was hit with a $1,050 abusive driver tax on top of the usual $100 traffic fine. Now, a bicyclist has been ordered by the Newport News district court to cough up the $1,050 surcharge for going too fast on his 18-speed Huffy:Bicyclist Kajuan Cornish, 19, has not accumulated a bad driving record because he does not own an automobile. That did not stop Newport News Police Officer George Evans for writing up Cornish as he pedaled down Warwick Boulevard near Denbigh Boulevard on December 27. Cornish was headed back to work after taking a lunch break. WAVY-TV has more of the silliness: Cornish says his reckless driving ticket might one day be funny, if it weren't so confusing."I get some people who laugh," he says, "and I get some people, like me, that are lost."He reads his ticket out loud."Year? None. Make? None. Type? Bike. License? None. State? None." Cornish may be among the last who have to fight the surcharges. They're in court on an Equal Protection Clause challenge, and the Governor recently conceded that it's time to repeal them.More on Virginia tax issues here. | | By: Tax Policy Blog | | |

| Virginia Governor Reiterates Driver Surcharge Repeal | | 2008-01-17 00:00:00 | | In a Washington Post chat yesterday, Virginia Governor Tim Kaine reiterated his recent decision to seek repeal of Virginia's abusive driver surcharges, which we mentioned earlier this week:Alexandria, Va.: When exactly will the abusive driver law be repealed and will it be retroactive? Tim Kaine: I believe the legislature will follow my suggestion that the abusive driver fees should be repealed. Normally, this kind of legislative action would be implemented on July 1, but if the legislature votes in a super-majority fashion for the repeal there are some circumstances where it can take place immediately. Some of the introduced legislation includes a rebate for those who have been affected already. We've covered how this is an example of politicians targeting easy revenue sources for punitive taxes, the public outcry over the huge assessments, and finally, the pending court challenges, so it's good that they may soon be history. With refunds for those who have had to pay the surcharges, too! | | By: Tax Policy Blog | | |

| Virginia Governor Open to Repeal of Abusive Driver Surcharges | | 2008-01-15 00:00:00 | | We've written before on Virginia's "abusive driver fees" and "civil remedial fees," and why they are just a tax on traffic offenses. Because the revenue goes to general state spending, they are properly called a "tax" and not "fees." We've covered how this is an example of politicians targeting easy revenue sources for punitive taxes, the public outcry over the huge assessments, and finally, the pending court challenges. After defending the surcharges for months, Virginia Governor Tim Kaine (D) may be ready to give up on them. At the end of yesterday's State of the State Address, he said he would sign a repeal:The imposition of higher fees on drivers who commit serious traffic offenses was designed to both increase transportation revenue and encourage safer driving habits. After six months, neither goal has come to pass. The abusive driver fees will not generate the amount of revenue we had hoped. And neither the number of traffic tickets issued nor the tragic number of deaths on Virginia highways last year indicate that the fees have improved highway safety. Virginia citizens in huge numbers have told us that the fees should be repealed. We should listen to them. I hope that this session, you will send to my desk a bill fully repealing the abusive driver fees. | | By: Tax Policy Blog | | |

| Virginia trying to ban cellphone use while driving | | 2008-01-14 12:40:00 | | I don't even know how this isn't a law already in all states. How safe can it be to be looking down at your phone typing in a text message while driving down the road? It completely boggles the mind. Are insurance lobbyists in control of the legislators? I'm sure once the son or daughter of a senator dies because of cell phone use, the bill will get pushed through. This one deserves a big WTF?

| Yes Virginia, Santa is sh*t-faced | | 2007-12-26 08:31:04 | | “T’was the day after Christmas and all through the house, not a creature was stirring, for fear of waking papa, the drunken louse.”We here at TheSharkBook.com having neglected to wish you, our loyal readers, a happy holiday season would like to at least wish you a happy Boxing Day: may the bargains you meet be plentiful, and the exchange policies on some of the crappier gifts you received lenient. For our final X-mas-related blog of this year, we wanted to touch on a trend that our book, The Man Who Scared a Shark to Death (and other true tales of drunken debauchery), was, to our knowledge, the first to chronicle: the seeming appeal of donning a Santa Claus outfit and making a sorry-ass drunken public nuisance of oneself. (Editor’s Note: For more on this theme we recommend the excellent Billy Bob Thornton film “Bad Santa”, one of the very best boozing comedies ever made). We covered more than one such case in The Man Who Scared a Shark to Death – the most disgraceful of all likely being a drunken riot that broke out at the finish line of a charity marathon where the participants were dressed as ole Saint Nick himself and some of the more well-oiled elfs had to be beaten and pepper-sprayed into submission. There seems to be something about donning the garb of Santa Claus – the best collaborative effort between Coca Cola and the Roman Catholic Church since Holy Water Soda – that appeals to drunks, and this year was no exception.First, in Christchurch New Zealand, where a gang of about 50 drunken Santas broke into a cinema, shoving families aside, tearing down posters and kicking things over while shouting the unorthodox holiday greeting “Ho f*cking ho!” One woman who was waiting in line to see the movie “Enchanted” with her two ankle-biters in tow was sickened by this less than enchanting display and her kids were puzzled as to why these Santas were acting like their soccer hooligan older brothers: "They asked me, 'are they Santa's helpers g | | By: The Shark Guys | | |

| ACLU Representing Lesbian High School Student in Virginia for T-Shirt Scandal | | 2007-12-21 15:24:47 | |
I don't know if Bethany Laccone wore any one of these above t-shirts or not, but I DO know that her teacher and the school's administrators are clearly showing their bigotry against her choice of sexual orientation and this is undoubtedly unconstitutional.
Ah conservative family values...so disrespectful and intolerant of ALL types of families, aren't they? SIGH.
Good luck to the ACLU and the national ACLU Lesbian Gay Bisexual Transgender Project with this case, you guys. A new year is beginning very shortly and it is the perfect time for a more openminded attitude.

| 2007 one of the ten warmest years on record; Seventh warmest for Virginia | | 2007-12-19 08:00:00 | |
According to a report issued last week from the National Oceanic and Atmospheric Administration (NOAA), the year 2007 will go down as one of the 10 warmest years on record for not only the contiguous United States, but also the entire planet.
In the United States:
The preliminary annual average temperature for 2007 across the contiguous United States will likely be near 54.3° F- 1.5°F (0.8°C) above the twentieth century average of 52.8°F. This currently establishes 2007 as the eighth warmest on record. Only February and April were cooler-than-average, while March and August were second warmest in the 113-year record.
The warmer-than-average conditions in 2007 influenced residential energy demand in opposing ways, as measured by the nation’s Residential Energy Demand Temperature Index. Using this index, NOAA scientists determined that the U.S. residential energy demand was about three percent less during the winter and eight percent higher during the summer than what would have occurred under average climate conditions.
Exceptional warmth in late March was followed by a record cold outbreak from the central Plains to the Southeast in early April. The combination of premature growth from the March warmth and the record-breaking freeze behind it caused more than an estimated $1 billion in losses to crops (agricultural and horticultural).
A severe heat wave affected large parts of the central and southeastern U.S. in August, setting more than 2,500 new daily record highs.
Across the globe:
The global annual temperature − for combined land and ocean surfaces – for 2007 is expected to be near 58.0 F – and would be the fifth warmest since records began in 1880. Some of the largest and most widespread warm anomalies occurred from eastern Europe to central Asia.
Including 2007, seven of the eight warmest years on record have occurred since 2001 and the 10 warmest years have all occurred since 1997. The global average surface temperature has risen between | | By: The Colette

| Book Review: Shaggy Muses: The Dogs Who Inspired Virginia Woolf, Emily Dickinson, Elizabeth Barrett Browning, Edith Wharton, and Emily Bronte | | 2007-10-03 12:14:20 | | Author Maureen Adams wrote a wonderful overview of these famous women writers in her book Shaggy Muses. She explores each writer's life within the context of their relationship and dependence on their dog(s). If you are a dog lover, you can connect to the strong bonds between the women and their dogs. A dog is always accepting and incredibly tolerant. These dogs were no different and constantly, devotedly listened to their mistresses recite their work without ever appearing critical. They also kept the writers from feeling too much loneliness during their literary solitude.Even if you are not a dog lover, this book offers a great overview and introduction to some of the most famous women writers of English literature. I do have to warn you; however, some of the experiences these women went through were painful.Pick up a copy of "Shaggy Muses: The Dogs Who Inspired Virginia Woolf, Emily Dickinson, Elizabeth Barrett Browning, Edith Wharton, and Emily Bronte" by Maureen Adams.Published 2007.Women's Success History

| Bootlegged Marlboros from Virginia Intercepted in Upper Marlboro, Maryland | | 2007-09-24 07:00:00 | | The Fox affiliate in Washington, DC reports that over the weekend police in Upper Marlboro, Maryland (pretty ironic) intercepted a van hauling 300 cartons of cigarettes which had been purchased in Virginia. Authorities suspect that the cigarettes were bound for a high-tax jurisdiction such as New York City or New Jersey. The economics of so-called "buttlegging" are pretty straightforward. In Virginia the tax on cigarettes is 30 cents per pack, or $3.00 per carton. In New York City the tax is ten times that amount: $3.00 per pack or $30.00 per carton. This creates the situation where it is possible for smugglers to earn as much as $27.00 on every carton smuggled into the city, or $8,100 per 300 carton vanload. Not bad for a five hour drive. It's no surprise that the Big Apple is awash in bootleg cigarettes.Unfortunately, tax evasion is the least of the Big Apple's problems when it comes to its illicit cigarette market.
